Supreme Court on Delhi Air Pollution: The
highest law authority, the Supreme Court has finally arisen concerning the
‘worse than an emergency situation’ of Delhi. The court maintained that it
cannot leave Delhiites to die, and the situation does need its interruption. On
Monday, the court warned the governments of Haryana, Punjab and Uttar Pradesh
to stop stubble burning. The SC has said in the strict words that the entire
administration including the police, secretary, sarpanch, etc. would be held
responsible if another instance of stubble burning takes place in these states.
SC BURSTS ON STATE GOVERNMENTS

“There cannot be a mass exodus from Delhi… People have to live
in Delhi, which is the national capital. People cannot be just evacuated from
here… No room inside a house is safe in Delhi. Even inside the house, it is
polluted. Can we survive like this? How long can we survive on air purifiers?
We are losing precious years of our lives… It is writ large that various State
governments, civic bodies have failed to discharge their liabilities. It is
time to fix liability… This is a shocking state of affairs,” the frustrated
Bench of Justices Arun Mishra and Deepak Gupta asserted.
Justice Mishra said, “Who is responsible for stubble burning? State governments are responsible! They are only interested in electioneering. They have to be made liable in tort. We are making a mockery of everything.”
“We will haul up the State administration from bottom to top. People are dying, this just cannot happen in a civilized country. The sad thing in this country is that people in power are only interested in gimmicks…every year stubble burning is happening? If you people were responsible, this would not have happened. Today the situation is grim.” He furiously addressed the governments of Punjab and Haryana.
This bench of Supreme Court yesterday lost temper when they found that the state governments are taking it lightly, and are not serious about public health emergency in Delhi. In the all-day-long hearing, they summoned the Chief Secretaries of Haryana, Punjab, and Uttar Pradesh and asked them to appear before the court on Wednesday.
Punishments, Fines And Penalties On Breaking The Rules
The court has announced that the state authorities would be held responsible if they do not extinguish field fires that have become the major reason behind Delhi Air Pollution. The court has taken some steps to reduce pollution. It has banned all sorts of Construction, demolition, burning of garbage, and all such activities.
- According to the latest order, any violation of the above order would result in a penalty of Rs 1 Lakh.
- People found burning garbage would be fined Rs 5000.
- The court has also banned the use of diesel generators in Delhi & NCR
- No industry in Delhi can use coal as fuel, and people violating it would have to appear before the court.
